India Introduces New MAP Guidelines
The Central Direct Tax Council of India has published new guidelines for the Mutual Agreement Procedure (MAP). The MAP Guidelines are divided into four parts, including
- Part A: Introduction and Basic Information;
- Part B: Access and Deny Access to MAP;
- Part C: Technical Issues;
- Part D: Implementing MAP Results.
The new guidance has been published in accordance with BEPS Action 14 (Improving the Efficiency of Dispute Resolution) and takes into account the latest amendments in accordance with the 23/2020 Notice dated May 6, 2020. This notice contains the Income Tax (8th Amendment) Regulations 2020 to amend the 1962 Income Tax Regulations on the MAP. The amendments replace and significantly expand the guidance that entered into force on 6 May 2020.
